Dear Friends and Clients:
On June 30, 2017, the General Director of Foreign Trade, of the Ministry of Economy, published a notice dated June 22, 2017, in the Federal Official Gazette, titled “Notice to inform the numbers of the suspended programs of the manufacturing, maquiladora and exportation service industries and the names of their beneficiaries”.
Said notice specifies the names of the beneficiaries of IMMEX Programs and the identifying numbers of IMMEX programs suspended due to any of the following reasons:
- The lack of presentation of the annual report of their total sales and of their exportations for the 2016 fiscal year.
- Due to the non-compliance with the requirements of Fraction III of the First paragraph of article 11 of the IMMEX Decree and, therefore, the lack of presentation of the mentioned report.
But, according to the notice itself, the beneficiaries of the suspended IMMEX programs, shall have until the last business day of August of 2017, to:
- Present their annual report of their total sales and of their exportations for the 2016 fiscal year.
- Comply with the requirements contained in Fraction III of the First paragraph of Article 11 of the IMMEX Decree.
The Ministry of Economy will rescind the suspension of the IMMEX programs to which the notice refers, whose beneficiaries comply with the contents of the preceding paragraph, within, at the latest, two business days after the Tax Administration Service (SAT by its initials in Spanish) informs the Ministry of Economy, that the beneficiary of the IMMEX Program complied with the requirement that caused the suspension of its IMMEX Program.
The IMMEX Programs of those companies that do not cure their omissions, shall be definitely cancelled, as of September 1, 2017.
