On July 17, 2025, the Federal Official Gazette published the Provisions on Occupational Hazards to guarantee the right to rest during the workday for employees who work in a standing position in the service, commerce, analogous workplaces, and industrial establishment sectors.
These provisions aim to ensure the right to rest during the workday for individuals who work standing up (bipedestation), primarily in the service, commerce, and analogous or industrial workplace sectors.
Employer Obligations:
Risk Analysis and Diagnosis:
- Conduct an analysis of working conditions for employees in a standing position.
- Include this analysis in the occupational health and safety program (in accordance with NOM-030-STPS-2009).
- Update the Internal Work Regulations and applicable policies.
Record in Health and Safety Logs:
- Document risks and preventive measures for standing workers during the safety and hygiene committee’s inspection rounds.
- The log must include data such as: inspection date, area with a description of working conditions, tools used, type of standing posture, health status, age, required level of care, type of manual physical load involved, continuous time worked in such posture, and factors that may increase the risk of standing, among others.
Individual Risk Level Assessment:
- Determine the risk level for each worker based on 7 criteria established by the guidelines.
Provision of Adequate Furniture:
- Provide appropriate seats or chairs with backrests according to the identified risk level.
- Chairs must meet ergonomic standards (backrest, height, lumbar support, armrests, stability, etc.).
Additional Preventive Measures:
- Adapt workstations to allow for rest.
- Alternate tasks to enable posture changes.
- Provide ergonomic footwear.
- Use anti-fatigue floor mats.
- Establish active break times during the workday.
Training and Information:
- Inform workers about the risks of working in a standing position and the measures implemented.
- Provide training on the use and care of the provided seat or chair.
Signage and Medical Attention:
- Mark designated rest areas if they differ from the work area.
- Refer employees who show symptoms related to standing work for medical attention.
All aspects not covered in these provisions, as well as their interpretation, will be resolved by the Ministry of Labor and Social Welfare, in accordance with the Federal Labor Law and other applicable regulations.
These measures are mandatory as of July 17, 2025, and compliance will be supervised by the Ministry of Labor and Social Welfare. Companies have a period of 180 calendar days from the publication date to fully comply.
