Constitutional Reform: Reduction of the Work Schedule in Mexico

On March 3, 2026, the Decree amending Article 123 of the Political Constitution of the United Mexican States was published in the Official Gazette of the Federation, establishing the reduction of the weekly work schedule to 40 hours.

Key Changes:

1. The maximum workweek will be reduced from 48 to 40 hours, in accordance with the provisions established in Labor Legislation.

2. The reduction will be implemented progressively as follows:

2027: 46 hours

2028: 44 hours

2029: 42 hours

2030: 40 hours

3. The reform also modifies the rules governing overtime work:

a) The first 12 hours of overtime will be paid with a 100% premium over the regular hourly wage.

b) These hours may be distributed as follows:

If these limits are exceeded, the employer must pay a 200% premium over the regular hourly wage.

Additionally, individuals under 18 years of age may not perform overtime work.

4. The reduction of the workweek may not result in any decrease in salaries or benefits.

5. Congress must harmonize secondary legislation, including the Federal Labor Law, within 90 days.

6. The reform enters into force on the same day of its publication.

This reform will require progressive adjustments in work schedules, operational planning, and labor costs, therefore it is advisable to begin compliance assessments and implementation strategies, before January 1, 2027.
