On April 22nd, 2024, a DECREE that amends the Import Tariff of the General Import and Export Duties Law was published in the Federal Official Gazette (the “Decree”), which became effective the day after its publication (April 23, 2024) and will remain valid for the following 2 (two) years.
It is important to mention that the Decree establishes temporary import duties ranging between 5% to 50% to certain goods classified in 544 HTS Codes related to steel, aluminum, textile, apparel, footwear, wood, plastic and related items, chemical products, paper and cardboard, ceramic products, glass and related items, electrical material, transportation material, musical instruments, furniture, among others.
Notwithstanding the above, the Decree states that in the case of goods originating in countries with which Mexico has entered into a trade agreement, if the corresponding requirements are fulfilled, the preferential duty treatment of originating goods provided for in the corresponding international instrument may continue to be applied.
The Decree also states that in order to avoid affecting the productive chains and to maintain competitiveness in the most sensitive industrial sectors, such as the electric, electronic, automotive and auto parts sectors, it is necessary to maintain, for the same period of effectiveness of the import duties set forth in the Decree, that is, for a period of 2 (two) years, the preferential duty treatment under the Sectorial Promotion Programs (PROSEC) applicable to various HTS Codes indicated in the Decree pertaining to certain steel products, which are included in the Programs for the electric, electronic, automotive and auto parts industry sectors, respectively.
Likewise, by means of the second transitory article of the Decree, the “Decree that amends the Import Tariff of the General Import and Export Duties Law” published in the Federal Official Gazette on August 15th, 2023, is repealed.
