Legitimacy of collective bargaining agreements

Dear Clients and Friends:

On March 6th, 2023, the Federal Center for Conciliation and Labor Registration published a resolution announcing the deadline for the registration of and compliance with the legitimization procedures of the current collective bargaining agreements in the Official Gazette of the Federation.

This Resolution confirms that May 1st, 2023 is the date on which the registration of the Legitimization of the existing Collective Bargaining Agreements expires, as established in the Eleventh Transitory of the Reform Decree published on May 1st, 2019.

Additionally, the Resolution establishes July 31st, 2023 as the expiration date for compliance with the consultations regarding the legitimization procedures of the existing collective bargaining agreements and those that were registered before May 1st, 2023.

It is important to remind you that noncompliance with the legitimization procedure of the existing Collective Bargaining Agreements within the May 1st, 2023 deadline, shall cause said Collective Bargaining Agreements to be deemed terminated. For the benefit of the workers, the benefits and working conditions superior to those provided for by the  Law that were in force shall remain.
