Dear Clients and Friends,

Derived from the General Administrative Provisions issued by the Energy Regulatory Commission (“CRE”) and published on February 15th, 2018 in the Official Gazette of the Federation (“DOF”), users of natural gas whose annual consumption exceeds 5,000 GigaJoules (“Major Users”) must contract their gas supply directly from a commercialization company that is different from their local distribution company.

Resolution RES / 1827/2016, published in the DOF on December 20th, 2016, extended the deadline to implement this update for contracting natural gas suppliers until February 28th, 2018. However, in practice, commercialization companies have just started sending their supply contracts’ formats to their prospective clients, which is the reason why if your company has a natural gas consumption exceeding 5,000 GigaJoules per year, you will have until the end of this month to negotiate and execute these contracts with the commercialization company of your choice.

Should you have any questions or comments regarding the foregoing, or if you require legal advice for the development or implementation of your new natural gas acquisition scheme in order to comply with the applicable legal provisions, our corporate and energy practice groups are at your service.
