Protocol for the Legitimisation of collective bargaining agreements

The Federal Government published the Protocol for the Legitimation of Collective Contracts throughout the country, which entered into force on August 1.

The main points are:

All unions must comply with this obligation within a maximum period of four years.
The legitimation procedure guarantees that workers know and approve the content of their collective agreements through personal, free, direct and secret voting.
The Protocol establishes that the general secretary or the legal representative of the union that holds the collective contract to be legitimated must give notice of the consultation to the STPS through the electronic platform created for this purpose and register the information of the union, the employer and the collective contract.
Those unions that require consultation in multiple locations or on multiple days must make this known to the STPS for its particular attention.
To ensure that workers vote freely, safely and secretly, the Protocol provides that the consultation may be verified by a notary public or a labor authority. The union will choose the modality of its preference and will indicate the place, date and time in which the event will take place.
Once the event is registered, the platform will generate the invitation, ballots and voting acts to be used for the consultation.
The Company is prohibited from participating in this process.
If the Collective Bargaining Agreement is not approved, the benefits established therein are protected.
