We remind you that the submission of the risk premium declaration to the Mexican Social Security Institute (“IMSS”) is a mandatory procedure that must be completed no later than the last day of February.
It is important to be aware that situations such as illnesses or accidents suffered by workers throughout the reported year can significantly impact the increase of the risk premium.
We have noticed that, in certain cases, diseases generally not related to work are classified by IMSS doctors as work-related illnesses. Additionally, it is common for permanent disabilities, whether partial or total, resulting from workplace accidents or diseases, to be assessed at a percentage higher than what truly corresponds.
These and other similar situations can result in an undue cost increase for companies.
As resolved by the Supreme Court of Justice of the Nation in 2018, workplace hazards that are disagreed with must be contested along with the rectification of the risk premium; Thus, it is necessary to omit such hazards in the risk premium declaration. To avoid contingencies and ensure proper handling of these cases, prior guidance from our team is extremely important.
