TEMPORARY SUSPENSION OF THE AMPAROS ACTIONS AGAINST THE NEW MINING LAW

Dear Clients and Friends,

On July 15, 2024, the Supreme Court of Justice of the Nation published an agreement in the Federal Official Gazette suspending the issuance of definitive judgments in the amparo actions against the reforms of the laws on Mining and National Waters.

This decision seeks to establish a single criterion regarding the constitutionality of the Mining Law reform, ensuring legal certainty for stakeholders. Accordingly, it specifies that priority will be given to resolving Constitutional Action 129/2023, Constitutional Controversy 86/2024, as well as various amparo appeals currently pending before the Court.

The Court’s determination on these matters will be crucial for the mining sector, as it will set the precedent to be followed for resolving the amparo cases awaiting final judgment.

This Court’s criterion will not only shape the future of these reforms but also establish a solid legal framework for the mining sector.
