On July 17, 2025, the Official Gazette of the Federation published the Provisions on Occupational Risk Factors to Guarantee the Right to Rest during the Workday for Employees in Standing Positions.
We would like to remind you that the deadline to comply with the provisions of the so-called “Chair Law” is December 14, 2025. To that end, it will be necessary, among other obligations, to:
• Include in the Internal Work Regulations provisions related to the use of chairs, breaks, and ergonomic conditions, in accordance with the principles of dignity and worker well-being.
• Update internal occupational health and ergonomics policies to incorporate the obligation to allow alternating positions.
• Implement training and awareness programs regarding the right to sit, ergonomic working conditions, and employer obligations.
• Adjust work schedules to allow rest periods.
Failure to comply with these provisions may result in fines ranging from 250 to 2,500 Units of Measurement and Update (UMA), equivalent to approximately MXN $28,350 to MXN $283,500, based on the UMA value in 2025. These penalties will be applied for each affected employee and will be determined by the Ministry of Labor and Social Welfare (Secretaría del Trabajo y Previsión Social, STPS).
Furthermore, as we have previously discussed, we strongly recommend proactively amending your Internal Work Regulations to comply with the labor inspection protocol with a gender perspective issued by the STPS.
