Dear Clients and Friends,
In order to standardize the normative provisions governing the procedure for obtaining temporary or permanent residence in Mexico, the Ministry of the Interior published the Agreement amending article 32 of the Guidelines for Migration Procedures (“Agreement”).
Published in the Official Gazette of the Federation on December 30, the Agreement provides for the incorporation in the Guidelines of certain hypotheses concerning the validity period of residence permits in the country, provided for in the Migration Law and its Regulations, which were previously not included.
To date, scenarios for obtaining and processing permanent and temporary residence in Mexico are as follows:
1. Individuals over 18 years
Permanent residence cards shall be valid indefinitely.
2. Minors
Two situations are envisaged:
a. For children under 3 years, permanent resident cards shall be valid for 1 year from their entry into Mexico.
In this case, their migration document must be renewed every year until they reach the age of 3. From that point on, they must renew it every 4 years until they reach the age of 18.
2. Children and youngsters over the age of 3 and under 18 must renew their permanent visa every 4 years from their entry into Mexico.
Upon reaching the age of 18, and once the proper procedure is completed, permanent residence cards will be valid indefinitely.
3. Temporary residents, student temporary residents and visitors aiming to adopt a child
Temporary residence cards shall be valid for 1 year from their entry into Mexico
4. Temporary workers
Permits shall be issued for 2, 3 or 4 years, as provided in the employment offer and international or inter-agency instruments or agreements signed by the Ministry of Foreign Affairs.
Under the Agreement, which entered into force on December 31, the Guidelines for Migration Procedures have been amended to include all of the above scenarios, in order to provide greater legal certainty to those concerned.
