Through agreement published on December 8 in the Official Gazette of the Federation, the National Institute of Copyright (INDAUTOR) set forth the legal framework for the online filing, processing, and resolution of applications for the registration and copyright of original works. The purpose is to facilitate the processing of these filings by electronic means.
The most relevant aspects of the agreement are the following:
- Submission of applications and related promotions will be carried out through the INDARELIN.
- The online procedure is optional, but once started, it cannot be changed to the face-to-face modality. The filings cannot be started simultaneously under two modalities.
- The application for registration and promotions can be carried out 24 hours a day, 365 days a year. A control number will be assigned for the processing on the following working day.
- Requirements for the submission of applications and promotions will be available at: https://www.indautor.gob.mx/tramites-y-requisitos/registro/registro_obras.php
- To access INDARELIN, users must create an account at: https://sindautor.cultura.gob.mx
- Documents entered shall vest the same legal effects as those in original or certified copy and will have the same evidentiary value.
- Users must declare under oath that the documents entered are a true copy of their original, which they must present if requested by the INDAUTOR.
- Once the registration procedure is completed, users will be able to view and download the resolution directly from the INDARELIN.
- Responses to requirements made by the INDAUTOR must be carried out using the advanced electronic signature.
The agreement will enter into force 15 days after its publication. Two months after such date, all emails related to the following accounts will be disabled: [email protected] and [email protected]
The records and resolutions pending at the closing date will be sent to those concerned within the next 15 working days.
