On July 1, 2020, the Federal Government published in the Official Gazette of the Federation the new “FEDERAL LAW FOR THE PROTECTION OF INDUSTRIAL PROPERTY”, which will enter into force 90 business days as of the date of publication (November 5, 2020).
This new, modern and innovative Federal Law for the Protection of Industrial Property (LFPPI) derives from the following four elements (i) the need to adapt the Mexican system to the new technologies and developments offered by the current global trade (the current Industrial Property Law dates from 1991 and has undergone more than 20 reforms and additions, making it obsolete and complex); (ii) the signature of the Transpacific Economic Partnership Agreement (also known as TIPAT) to which among Mexico and Canada, 9 countries of Asia and Latin America are parties; (iii) the renegotiation and modernization of the Free Trade Agreement between Mexico and the European Union (TLCMUE, which will enter into force on September 2020); and (iv) the new Free Trade Agreement between Mexico, the United States and Canada (USMCA, in force as of June 20, 2020).
The legislations of every country (46 in total) with which Mexico has commercial agreements require our country to modernize its Intellectual Property system, this is why the LFPPI had to be enacted.
