Dear Clients and Friends,
The Ministry of Economy is responsible for establishing non-tariff measures to regulate or restrict the importation of goods into Mexico.

As part of these non-tariff measures, the Ministry of Economy established in numeral 8, section II, of Annex 2.2.1 of the Rules and Criteria of a General Character in Matters of Foreign Trade, that the goods included in the tariff sections mentioned therein (steel products), and that are destined to the definitive import customs regime, are subject to the presentation of an automatic notice before said Ministry.

However, on August 11, 2014, a sixth paragraph was added to numeral 10 of Annex 2.2.1, according to which an Alternative Mechanism was established to comply with the presentation of the automatic import notification, based on the condition that the issuer of the mill or quality certificate guarantees its veracity or, as the case may be, that the importer has a certification from the tax authorities or from the Ministry itself that determines the veracity of the corresponding information.
Notwithstanding the foregoing, on December 31, 2018, through official letter number 4141.2018.5567, the suspension of the Alternative Mechanism was notified due to the detection of various inconsistencies in its operation, such as non-compliance with the obligations acquired, the lack of presentation in time and form of quarterly reports or the presentation of incomplete documentation.

However, as of July 16, 2019, the Alternative Mechanism was re-established for those mills and importers that, prior to its suspension, were up to date with the obligations established in numeral 10, sixth paragraph, of Annex 2.2.1 mentioned above, such as, among others, the presentation of mill certificates and quarterly reports.

In order to generate more room to redefine various aspects of the operation of the Alternative Mechanism, the Ministry is currently working on the redesign of the operation of the Alternative Mechanism, so that, in a timely manner and once the procedures to be followed have been determined, the beneficiary mills and importers will be informed.

As soon as the Ministry releases more information related to this matter, we will be communicating it to you by this means.
