National Antitrust Commission (CNA) announces new fees

On December 19, 2025, the National Antitrust Commission (CNA) announced the new fees that will apply to the services provided by said Commission, specifically, the notification of mergers, issuance of certified copies, comparison or verification of documents, and any certification or issuance of records other than the two previous cases.

According to the Agreement modifying the fees in question, these new rates are intended to strengthen the financial autonomy of the Antitrust Commission and reduce its dependence on budgetary resources.Furthermore, in the case of merger notifications, the value of the transactions analyzed has an impact on the financial and human resources required for their analysis.

In the case of merger notifications, the fee to be paid is now set on a sliding scale, with five intervals depending on the value of the transaction, to which Value Added Tax (VAT) must be added at the time of notification, as follows:

These fees must be declared at the initial stage of notification of the transaction (written notification of the merger) and may be modified by the Commission if it considers that a different fee to that declared is applicable.

If the difference between the declared rate and the rate to be paid is less, the remaining amount will not be returned to the notifying economic agent.
