On October 23th, the Mexican Labor Ministry published the NOM-035-STPS-2018, Psychosocial risk factors at workplace-Identification, analysis and prevention. It provides for normative requirements that aim to establish specific elements to identify, analyze and prevent psychosocial risk factors, as well as the evaluation of the organizational environment and its favorable promotion in the workplace.

Psychosocial risk factors are those that can cause non organic anxiety disorders, the sleep-wake cycle, severe stress and adaptation disorders derived from the nature of the job functions, the type of work and the exposure to severe traumatic events due to the job carried out or acts of labor violence against the worker.

The document provides both the employer’s and the employee’s obligations regarding the implementation, maintenance and communication of a prevention policy in the workplace, as well as the corresponding participation and evaluation of employees regarding psychosocial risk factors.

It establishes requirements to identify and analyze the psychosocial risk factors and evaluate the organizational environment

The employer has the choice to engage with a credited and approved verification unit that evaluates the compliance with this regulation, issuing an expert opinion with a validity period of two years.

The NOM-035-STPS-2018 project was published for public consultation October 26th, 2016 with effective date October 23th, 2019.

It should be noted that some requirements will become mandatory as of October 23th, 2020.
