The decree reforming and adding various provisions to the Federal Labor Law (LFT) regarding workers’ right to rest during the workday, also known as the “Chair Law,” was published in the Federal Official Gazette today, December 19.
The decree amends Articles 132, 133, 422, and 423 of the LFT to establish new obligations and prohibitions for employers, including the following:
The obligation to provide enough seats or chairs with backrests for all workers in the service, commercial, and similar workplaces, to be used for performing their tasks or for periodic breaks during the workday.
- In the case of periodic breaks, the seats must be in specific areas designated for worker rest, which should be within the same workplace facilities. This provision also applies to industrial establishments where the nature of the work allows for it.
The obligation to establish mandatory rest periods during the workday in the Workplace Internal Regulations, as well as regulations governing workers’ right to use seats or chairs with backrests during the workday.
- It is prohibited to force workers to remain standing throughout the entire workday or to prohibit them from sitting periodically while performing their duties.
The referenced decree will come into effect 180 calendar days after its publication in the DOF.
To ensure compliance with the new provisions, the Ministry of Labor and Social Welfare (STPS) must issue the corresponding regulations on workplace risk factors within 30 calendar days of the decree’s entry into force.
Employers will have a period of 180 days from the decree’s entry into force to adjust their internal policies to comply with the new provisions regarding workers’ rest periods.
